Client data and our role

For personal data that a client supplies or controls in a project, the client normally decides why and how the data is used and acts as the controller or business. Turn Byte acts as a processor or service provider only to the extent it handles that data for the agreed services and on the client’s documented instructions.

The client remains responsible for the lawfulness, accuracy and source of its data; providing required privacy notices; obtaining any required consent; responding to individuals; and deciding how long the data should be kept. Turn Byte remains responsible for the duties that applicable law places directly on processors and service providers, including following lawful instructions, confidentiality, appropriate security, assistance and incident notification.

Project-specific data terms

A public webpage cannot replace the details required for a data-processing agreement. If a project involves personal data, the proposal or statement of work should identify the people and data involved, purpose and duration, approved platforms and subprocessors, retention or deletion instructions, security measures and any international-transfer safeguard. Where required, the parties will sign a data-processing addendum and applicable transfer clauses.

Priority of documents

A signed project agreement controls over the general website terms. Mandatory law controls where it cannot lawfully be changed by contract. Nothing on this website is legal, tax, accounting or regulatory advice to a client.
